In a video, Unnatural Vegan explains that having a backyard hen is acceptable as she thinks it is not a form of exploitation. She draws on the works of Tzachi Zamir who makes a distinction between use and exploitation. I believe that she is wrong in her interpretation of Zamir's work and wrong in her conclusion that keeping a backyard hen is morally just. Here is why.<br />

<span style="font-size: x-small;">This is a response to the videos <i>Tentative Vegan #2: Animal Use vs Exploitation</i> and its follow-up <i>Using Animals: Does Consent Matter?</i> by Unnatural Vegan.</span><br />

Unnatural Vegan, a fairly popular advocate for veganism on Youtube, has started a series of videos in which she explains why tentative veganism makes more sens as a moral position than 'normal' veganism. She draws forth on what she took from the book <i>Ethics and the Beast</i> by Tzachi Zamir. Zamir argues that animals can be liberated without us having to give up speciesism, which could be a factor in deciding our priorities in public debates.<br />

In her first video Swazy, who runs Unnatural Vegan, explains the difference between <i>use</i> and <i>exploitation</i> of animals, which is also covered by Tzachi Zamir. She argues that while exploitation is wrong, the use of an animal is not. To clarify her point she explains, in her first video on this topic, that Tzachi Zamir defines exploitation as follows.<br />
<blockquote class="tr_bq">
"X uses Y when he perceives Y as a means of furthering his own financial (or other) well-being. This turns into exploitation when X is willing to act in a way that is substantially detrimental to Y's own well-being in order to further his own.</blockquote>
<blockquote class="tr_bq">
By 'substantial' I mean that the action predictably carries consequences such as shortening Y's life, damaging his health, <b>limiting his freedom</b>, abusing what he is (e.g., some forms of prostitution), systematically thwarting his potential (e.g., child labor), or subjecting him to pain or to a strongly undesired life (e.g., demanding inhuman workloads ad thus creating human-slavery).</blockquote>
<blockquote class="tr_bq">
Exploitation usually also suggests <b>lack of consent</b> by the exploited party (or a consent that is predicated on a highly limited choice or on choosing among <b>impossible alternatives</b>). Exploitation is also mostly related to the existence of unequal <b>power relations</b> or some dependency relations between the parties, favoring the exploiting party in an institutional and systematic way." (emphasis by author)</blockquote>
Then she inserts that using a backyard hen is "use", not exploitation.<br />
<blockquote class="tr_bq">
"Of course a vegan could agree with this distinction between use and exploitation and still believe that use, in and of itself, is wrong. That even if no exploitation occurs that using, say, a backyard hen by consuming her unfertilized eggs would still be immoral because you are using the animal."</blockquote>
While it is good to make a difference between use and exploitation, having a backyard hen is, according to the definition Zamir, not an example of use that is exempt of exploitation, as Swazey seems to belief. His definition clearly states that use becomes exploitation when an animal its freedom is confined. Also Zamir indicates that a lack of consent, confinement of alternatives to the animal, and relationship in which one is dependent on the other, are indicators that there is exploitation going on. In other words, Zamir rather argues that only if a free hen lays an unfertilized egg in your backyard and leaves it deserted, it may be considered as use, without exploitation.<br />
<br />
In the case of a backyard hen, the space that the hen has, is confined to the property of the owner of the hen. Everyone who uses a backyard hen for the consumption of eggs, by definition limits the hens freedom to the borders of the yard, not allowing the hen to move elsewhere. One could bring in that the hen is equally happy with a smaller territory and has no clue about what is 'out there'. But truth is that the hen is prevented to find that out on its own. If we were to keep a human being in a confined space with barbed wire, or a fence, it is understood as immoral since we deliberately keep them unaware of the world beyond that.<br />
<br />
Seemingly ignoring all this, Swazey continues.<br />
<blockquote class="tr_bq">
"Assuming the hen is well-cared for and loved and all that stuff. What could be the harm? I don't even think you could argue that 'well they're being stolen from the chicken', because they're essentially a waste product... Do we really think that if a chicken could care, that she would care about us consuming her period? She may be a bit disgusted and worried about her mental state, but I don't think she feels slighted or exploited."</blockquote>
Again, Swazey seems to overlook much of the ethics involved in keeping a hen, and solely focuses on the general well-being of the hen. Indeed, the hen is probably not harmed when she is taken good care of and probably is not bothered when her unfertilized eggs are taken.<span style="font-size: x-small;"><b>[note]</b></span> But it is way too narrow to solely consider that part of the ethical question.<br />
<br />
Also, whether the hen feels exploited is irrelevant. I too doubt whether chickens have the mental capacity to feel exploited or understand what that could mean. But assuming they do not, or can not feel exploited, makes a horrible argument to go on exploiting an animal.<br />
<br />
More importantly, she seems to argue that being cared for in exchange for eggs is a good deal for hens, as accepting the deal increases their well-being. Even though there can exist mutual benefits, this is actually pretty much a take-it-or-leave-it deal, which is problematic in and of itself.<br />
<br />
Throughout her video she does not go into whether this deal is consensual. I get that. If something is consensual, it does not necessary mean it is the right thing to do. But lack of consent, as Zamir explained in its definition, is an indicator of abuse and should have been addressed. Many viewers therefore have commented in response, highlighting that she was ignoring that this relationship with the hen is devoid of consent.<br />
<br />
It seemed to me that she assumes consent from the well-being of the animal: as long as the animal is happy you can use him. If this was her take: the well-being argument to decide whether it is okay to use an animal is pretty flawed, since it immediately raises the question how well an animal should be, before it is okay to use it. Is there a hen-o-happiness scale that tells us this?<br />
<br />
I too <a href="https://www.facebook.com/unnaturalvegan/posts/1058897287455168?comment_id=1059285947416302" target="_blank">commented</a> on her Facebook profile that she seems to be mistaking "the well-being of animals for their consent to use them". Even though it may be a good deal for the hen, backyard hens are not asked about their opinions on this deal; in fact they are pretty much unable to give their consent. At the same time I told her that "Using hens that are bred by violation of their parents sexual freedom, which are deliberately constrained in their territory, is not vegan."<br />

<b>Does Consent Matter?</b></h2>

As a response, Swazey came with a follow-up video <i>Using Animals: Does consent Matter?</i> in which she explains why consent does not matter, according to her.<br />

"A lot of people are bringing up consent. That the problem that they have with animal use is that it does not involve consent. And as long as there is no consent, it is wrong. So to take eggs even from a rescued hen ... is still wrong because she has not given you consent to do so."</blockquote>
It could well be that this was what she took away from the criticism she received on her video. But, as explained above, the absence of consent does not necessarily mean something is wrong, but is an indicator of exploitation. Or as Zamir puts it, "Exploitation usually also suggests lack of consent by the exploited party". Hence, I would agree that a lack of consent (where that can not be given) does not necessarily mean that something is wrong. For example, rescuing a human in danger is not necessarily the wrong thing to do, regardless whether we have his consent. But the lack of consent should make us more responsible about the situation.<br />
<br />
Also notice how Swazey is now talking about a rescued hen, instead of the stereotypical backyard hen in the first video. Rescuing a hen from greater danger and then offering as much space as you can is a completely different situation than buying a newly bred hen for egg production.<br />
<br />
Her counter-argumentation starts with a distinction between those who can give consent, and those who can not. She tries to explain why consent does not really matter when we are talking about animals (spoiler: because animals are not capable of expressing their consent verbally)<br />

"But does consent really matter? I think intuitively we would all say yes, right? And to some extent rationally. Sex sans consent is rape. Borrowing sans consent is stealing. But in these cases we're dealing with adults. People who can consent. Who can give permission. What about infants?"</blockquote>

This is a remarkable statement, since the definition of exploitation which she quoted from Zamir in her previous video comes from a book that is all about animal liberation, and includes the lack of consent as at least an indicator for exploitation. </div>

Swazey is about to argue that if an animal is not able to give its consent, we then do not have to care about whether the animal consents or not. She does not explain why she sweeps it off the table. I would argue that consent is still on the table, and more importantly so, since the lack of consent means that we have a greater responsibility to think about the situation, than when we are given consent. Indeed, just like with infants. She continues her argument by making a comparison with children who are thought to be too young to make decisions.<br />
<blockquote class="tr_bq">
"What about infants. Infants can not say yay or nay. They can't decide who their guardians are. They can't decide where they live or what they eat. Or really anything at all. They have no say whatsoever in what happens to them. (...) Even law-abiding parents, they decide and are really controlling over their children."</blockquote>

Hold on, we are talking about morality here. And it seems that we are presented with the argument that since children are controlled by their parents, it must therefore be morally just. First, it would be more correct to say that the parents "care" for their children, as they morally should. Secondly, the fact that children are taken care for (or "controlled" as Swazey calls it), does not mean their consent is discarded. Most parents, actually do respect the consent of their children. If their stomachs are full, we do not shove more food down their throats. If a child does not feel like playing with Dinky Toys, we do not force them to do so. It is also not that infants can not show their consent at all. They can, though non-verbally. In fact, adults give many times their consent non-verbally.<br />
<br />
The great difference between adults and infants is how informed their consent is. The level of being informed about and understanding the situation, tells us whether an action is morally justified. The less capable one is to become informed, the more we get into the area where moral justification can not be derived from consent.<br />
<br />
Having (informed) consent does not necessarily mean that what we do is morally just. But when we act against the consent, it must be for a good reason. One could give a burning match to an infant, who eagerly tries to grab it, but that would still not be the right thing to do. Keeping the child away from a bonfire may also be devoid of his consent, but is obviously the right thing to do. This does not mean that consent is worthless. It means that we should achieve consent, or else have good reasons why we do something to someone else without their consent.<br />
<br />
Infants are hardwired to follow their parents, and therefore have no distinct preference for where they live, but they are quick to know who they want to live with: their parents. And anyone who tried to feed sour food like strawberries to infants, has seen how they show that this goes without their consent. Just because parents, as caretakers, have the right to make decisions on behalf of them, does not mean that they can disregard the consent of those they care for.<br />
<br />
Swazey of course wants to demonstrate that we sometimes put infants in a situation where their consent is disregarded. This is not because "controlling" infants is morally just. Nor all kinds of decisions parents could make are morally just. Only the decisions that are in the interest of the infant (and its future) are. Vaccination being one example.<br />
<br />
Without any regards to the above, Swazey assumes her audience agrees with her statement that infants can not give consent and continues with the deconstruction of a false comparison between one kind of necessity and another.<br />
<blockquote class="tr_bq">
"You may say "Okay fine, but you have to care for your child, it is necessary to do so, whereas adopting a chicken, a bird, and then eating its eggs is unnecessary." But is having a child necessary? I think for a lot of us it is not necessary, it is often unnecessary and can actually be viewed as quite frivolous." (1:33)</blockquote>
Perhaps one of her viewers threw this at her, but fact is that we are now jumping from a necessity to care for someone who can not fully take care for itself (a chicken, a child) to the question whether it is necessary to breed (a chicken, or a child). I think it is clear to anyone that in modern civilization it is not necessary to have a child, nor have a chicken. But once you have one, it is necessary to care for them.<br />
<br />
This is the last thing Swazey had to say on the topic of consent and concludes<br />
<br />
<blockquote class="tr_bq">
"So it seems to me that focusing on consent in regard to using non-human animals is not consistent with how we treat human animals."</blockquote>
While this is largely true, it does not tell us anything whether this difference is logical or not. Just because animals can not give informed consent to the level that humans can, does not mean they can not express some sort of consent. But indeed, when it comes to moral justification, consent becomes less worth if one is not capable to fully understand the situation. We therefore give less weight to the consent given by animals and infants to justify our actions. But it goes too far that animals can not give the slightest consent or that we should not consider their consent at all, as Swazey seems to suggest.<br />
<br />
She then heads on to comment on her critics who argued that taking the eggs is immoral since the chicken does not directly benefits. Here I agree with Swazey that not every action has to be a direct benefit to the hen. If the hen really does care as much about her egg as her poop, then there seems to me no moral objection to eat the egg (or poop if you are into that).<br />
<blockquote class="tr_bq">
"Of course some could argue as some of you have did in the comments, that using an animal is fine so long as the action benefits the animal. Then it is okay. So in the case of the child or the baby the parents being very controlling, regardless of consent is okay because it directly benefits the child. Having a safe place to live, food, all of this kind of things, whereas consuming rescued hen's eggs does not directly benefit the chicken and therefore is immoral. " (2.26)</blockquote>
The point here made is a difference between different actions. One being years of raising a child, the other one being the action of taking away an egg. Thus we are asked to compare a whole category of actions, with one particular action. This never works.<br />
<br />
Swazey resolves this by comparing two complete paths of caring, for either adopting a hen or an infant.<br />
<br />
<blockquote class="tr_bq">
"What about a situation in which the only reason someone adopts a chicken is so that they can consume her unfertilized eggs, so she now has a home, she now has food shelter, instead of being dead. Doesn't this benefit her? "</blockquote>
We should compare this to a couple that adopts a child. Are they right in using or selling things that the child produced, like drawings? Are the parents allowed to spend the benefits on themselves, or should all benefits go to the child? A relevant difference in the comparison between a hen and a child is that people rarely adopt a child to benefit from all the products they produce (during the time the child can barely give its consent). If couples would be doing this, I expect they will be frowned upon, as we intuitively understand that we are not supposed to adopt children to benefit ourselves. Following Swazey's reasoning, she would counter-argue that even when the child's products are used, the child would still have a better life than if it were not adopted. But I think that when the intention for adoption is to have benefits, it is an indicator (just like a lack of consent) that someone might be done wrong.<br />
<br />
Also, I think we should not only compare the whole of caring, but also look at parts in there, especially when it infringes the liberties of the hen or infant. Is it necessary to give the infant a pat? Is it necessary to curb the hen's area of movement? Yes, rescuing a hen or a child is better than not, but we should not stop there if there is room for improvement.<br />
<br />
<blockquote class="tr_bq">
"If the metric by which we deem an action moral or not is consent, then the consequences shouldn't matter: Use is abuse no matter what, in every case with regard to animals, because they cannot consent. The same can be said for infants, for someone who is comatose. If it is benefit that matters, then consent doesn't matter. So use is not abuse so long as the one being used benefits from the exchange. I would argue that both are wrong."</blockquote>
I think there is much semantics going on here. If we are taking the eggs of the hen, are we using the hen or are we using the egg? I think it is fair to say that someone who rescued the hen and takes the eggs is "keeping" the hen and "using" the eggs. Using the hen implies that the chicken is used instrumentally, which according to the "use is abuse" camp is wrong to do. And many philosophers agree that using someone solely for a purpose without their consent, is exploitation. And most philosophers would agree that it does not matter if the one who is used will be rewarded in the long run. On the other hand it is also not deemed moral to lure someone into a pyramid scheme, even though they conscientiously subscribe to it. I do not get why Swazey sees consent and consequences as mutual exclusive. Can't they both be guiding whether an action is moral or not?<br />
<br />
She then has a thought experiment for us that she copied from the user brimstoneSalad on the forum theveganatheist.com:<br />
<blockquote class="tr_bq">
"Perhaps I can not open doors, due to an injury. So, I lie in wait for an unsuspecting pedestrian to enter a building, thus opening the door, and I slip in behind him or her. I have used that person as a machine to my ends, and he or she did not give express permission for me to do it. Have I wronged him or her?</blockquote>
<blockquote class="tr_bq">
If this was a secure building, and that person was punished for accidentally letting somebody in, then yes. If this is a public facility, and the person suffered no injury from it, why would anybody argue that there's something wrong with this?"</blockquote>
In this situation the one being used, isn't harmed by being used, but neither benefits from it either. Again, there seems semantics at play. Is the person used, or was the opportunity used? As far I can tell the person was a free individual, and was not manipulated to act in a way. The person was not confined. This is a great difference with a hen, which is held at a location, perhaps even stalled. The term "use" may apply to the hen, while it probably does not apply to the free human.<br />
<br />
While she does not mention this difference, she does notice that there is a difference.<br />
<blockquote class="tr_bq">
"I don't think many of us would think there is something wrong with this scenario. And yet we do when it comes to a chicken's unfertilized eggs. What is the difference?"</blockquote>
For her answer she turned again to brimstoneSalad who wrote:<br />

It's not wrong to use any being, human or non-human animal, for your own ends as long as that use doesn't compromise their own ends. Saying it is, without valid explanation, is what makes veganism look irrational. </blockquote>
<blockquote class="tr_bq">
Only the most paranoid, petty, and psychologically unbalanced people care that somebody else "used" them, when that use was merely incidental and not malicious. It's very unlikely that any non-human animals have the elaborate and convoluted mental landscape to be that irrational. They don't care that we're using them, they care that we're hurting them.</blockquote>
There are again some semantics at play in brimestoneSalad wording, but what we get from this, is that it is actually not about "use", but about "compromising" the freedom of someone else. As mentioned before, a backyard hen has its freedom of movement limited. Thus, when we follow brimstoneSalad's reasoning, it is wrong to have a backyard hen. Ironically, Swazey chose this text to backup the statement in her first video that "using" a chicken as your backyard hen is not wrong and even raises that thinking otherwise "makes veganism look irrational".<br />
<br />
It is not the text by brimestoneSalad that can make a backyard hen morally just. Neither does a conflation between "using a hen" and "using the egg". What makes a backyard hen morally just in certain cases, is when there are no better options. We all agree that buying a hen to keep them as an egg producing machine is exploitation. Providing food and shelter to a rescued chicken could be morally just, if that is the best that we can do for them. Eating their waste products, like eggs may even be not an issue. Even the confinement of their space could be morally just, given a situation where greater freedom would put them at risk --to keep her away from a highway or the neighbor's dog. It is the best for them. This implies that we should be ready to send the chicken off to a place where she will find an even better home. If we 'forget' that in order to keep the hen around since we do not want to miss out on the eggs, then we do wrong. Once we rescued a hen, does not mean that we should stop looking for better homes. What we should not do is concluding that a relatively better live, is a sufficient good life.<br />

<span style="font-family: inherit; font-size: x-small;"><b>Note:</b> A hen can not tell the difference between her eggs and the eggs of other hens. It is therefore unlikely that a hen would know her egg is unfertilized. The modern hen does not care for the eggs she lays. Commercial farms did not bred for broodiness, but for the production of as much eggs as possible. The reason why the hen does not care when her eggs are taken away, is because humans have bred her specie to be like that. De man die het maatschappelijke debat aanzwengelt, Quincy Gario, pleit hoogstens voor het einde van de Zwarte Piet en minstens voor educatie op scholen over de duistere kant van de pietermannen.<a href="http://pauwenwitteman.vara.nl/media/301522" target="_blank"><span style="font-size: xx-small;">[6]</span></a> Het lot van Zwarte Piet ligt in de waag terwijl er twee quizvragen worden gesteld. De eerste vraag: 'Moeten we de traditie aan passen?' De tweede vraag: 'Gaan we een aanpassing maken?'.</div>

Volgens Quinsi Gario moet de Goedheiligman het doen zonder Zwarte Piet, omdat die symbool staat voor "racisme". Over wat we vinden van "racisme" zijn we het snel eens. Dat past niet in de 21e eeuw; het had nooit moeten bestaan. Als Zwarte Piet "racistisch" is, wordt het tijd om hem het roet van het gezicht te vegen. Maar is die dat ook? Ten eerste iets over die term. Ieder weldenkend mens begrijpt intussen wel dat de mens één ras is en geen verschillende. In ruime zin, doelt men met "racisme" op gedragingen waarbij de eigen etnische groep belangrijker wordt gevonden (etnocentrisme), er angst heerst voor buitenlanders (xenofobie), of etnische groepen gestigmatiseerd worden.<br />

Om aan te tonen dat Zwarte Piet hieraan schuldig is, wijst Gario naar het prentenboekje van Jan Schenkman dat gezien wordt als het model van de nationale sinterklaasverhaal. <span style="font-size: xx-small;"><a href="http://www.dbnl.org/tekst/sche039stni01_01/" target="_blank">[7]</a>,<a href="http://www.innl.nl/person/3263/nl" target="_blank">[8]</a>,<a href="http://www.volkskrant.nl/vk/nl/2686/Binnenland/article/detail/3531694/2013/10/23/Geen-twijfel-Zwarte-Piet-stamt-af-van-kindslaven.dhtml" target="_blank">[9]</a>,<a href="http://www.volkskrant.nl/vk/nl/3184/opinie/article/detail/3527041/2013/10/15/Zwarte-Piet-is-nooit-een-slaaf-geweest.dhtml" target="_blank">[10]</a></span> Die stelling wordt onderschreven door etnologieonderzoeker <a href="http://www.meertens.knaw.nl/cms/nl/medewerkers/142467-johnh" target="_blank">John Helsloot</a> en kunsthistoricus <a href="http://www.uva.nl/over-de-uva/organisatie/medewerkers/content/k/o/e.e.p.kolfin/e.e.p.kolfin.html" target="_blank">Elmer Kolfin</a>. En om het compleet te maken, kan ook het leiderschap van een blanke Sint naast de vaak 'dommige' Zwarte Pieten gezien worden als blanke superioriteit. Dat Zwarte Piet voortkomt uit 'racistische' denkbeelden lijkt evident. Maar hoe relevant is dit eigenlijk als geen van hen die het Sinterklaasfeest vieren nog associaties legt met de slavernij? Ik kan niet geloven dat de mensen die in deze tijd het sinterklaasfeest vieren, bezig zijn met het degraderen van 'zwarte' mensen. Sterker nog, Zwarte Piet en mensen met eenzelfde huidskleur worden als compleet andere entiteiten gezien.<a href="http://www.dichtbij.nl/rotterdam-zuid/regio/artikel/3124592/rotterdammers-zien-zwarte-piet-niet-als-slaaf.aspx" target="_blank"><span style="font-size: xx-small;">[11]</span></a> Nota bene, uit peilingen blijkt dat de traditievierende Nederlander Zwarte Piet uitsluitend met vrolijkheid associeert. Ik vind het dan ook niet echt eerlijk om de mensen die nu Sinterklaas vieren voor te houden dat ze 'racistisch' zijn. Er zijn mensen die dat hen wel verwijten en dat wekt <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> ik denk terecht <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> weerstand op. Zoals Rob Wijnberg zegt: Dat de mens van nu die associatie niet heeft, daar zouden we "juist verguld mee moeten zijn".<span style="font-size: xx-small;"><a href="https://decorrespondent.nl/233/wat-we-niet-zien/" target="_blank">[12]</a></span></div>

Vooral mensen van Antilliaanse en Surinaamse afkomst lijken moeite te hebben met Zwarte Piet. Ze zien zich gepersifleerd als Zwarte Piet en ervaren het archetype als een stigmatiserende karikatuur van zichzelf. Zoiets als Mart Smeets die Nico Dijkshoorn aanhoort.<a href="http://www.youtube.com/watch?v=zxVyNAJGztE" target="_blank"><span style="font-size: xx-small;">[13]</span></a> Dezelfde stigmatisering zien we ook bij de stereotypering van vrouwen als Barbie, mannen als He-men, Bulgaren als oplichters en Italianen als druktemakers. Anders dan Iran, dat Barbie heeft verbannen<a href="http://www.globalpost.com/dispatches/globalpost-blogs/weird-wide-web/iran-institutes-barbie-ban" target="_blank"><span style="font-size: xx-small;">[14]</span></a>, heeft Nederland geen cultuur waarin deze stigmatiseringen uitgebannen worden. Gekwetst voelen is de prijs die we betalen om ons te kunnen uiten.</div>

Waar ik mij niet aan kan onttrekken <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> dus ik zeg het maar <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> is dat veel mensen in het dagelijks leven erg bezet zijn met hun eigen afkomst en het benadrukken van elkaars etnische verschillen. Bijvoorbeeld cabaretier Salaheddine Benchikhi die deze week opmerkte dat een 'blanke kakstem niet klopt bij een neger'.<a href="http://www.youtube.com/watch?v=ANC0uNvssbk&t=1m56s" target="_blank"><span style="font-size: xx-small;">[15]</span></a> Of Prem Radhakishun die er door Jort Kelder op gewezen werd dat diens neiging om Obama te verheerlijken omwille van zijn huidskleur, eveneens 'racistisch' is. Natuurlijk, het kan ook grappig zijn, maar als we van stigma's af willen is dit ook een punt waar we wat ontspannender over mogen doen.<br />

Het Sinterklaasfeest en de rol van Zwarte Piet zijn gedurende de laatste decennia behoorlijk veranderd. Het is meegegaan met het feminisme en de vercommercialisering. Vergeleken met de tijd dat ik mijn schoen zette, zijn er nu meer Pieten, waaronder meer vrouwelijke pieten, en zijn de Pieten over het algemeen vrolijker, en minder dommig. Zoals Eric van Muiswinkel zegt:</div>

Die aanpassing aan de tijdsgeest is niet bijzonder. Het is iets wat we door de gehele geschiedenis zien gebeuren. Kerst was eerst een paganistisch ritueel om het lengen van de dagen te vieren (winterzonnewende). Pas daarna werd het ingelijfd door de christelijke overheersing <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> zoals met zoveel andere paganistische feesten gebeurde <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> dat het koppelde aan de vermeende geboortedag van Jezus-Christus en nota bene juist probeerde te voorkomen dat er onderling geschenken werden gegeven. De hedendaagse kerst gaat voornamelijk nog om gezelligheid met de familie. Diezelfde verandering van betekenis is te zien bij carnaval. Andersom kan het ook: De swastika en de Romeinse groet, werden symbolen van het Duitse nazisme.</div>

Moeten we het Sinterklaasfeest helemaal niet meer vieren, vanwege de nare historische wortels? Dat lijkt mij niet. Negatieve associaties zijn doorgaans geen reden om een viering af te schaffen. Nederland kent vele vieringen die niet brandschoon zijn. Neem bijvoorbeeld de bevrijding van Den Briel op 1 april. Dat ging niet zonder de ophanging van lokale geestelijken, de martelaren van Gorcum. Een smet op het blazoen van de 1-aprilviering. Nederland is er goed in geworden om ook de negatieve kanten te belichten. De viering van 400 jaar VOC was een voorbeeld waarbij respectvol stil werd gestaan bij de wan- en misdaden waarmee rijkdom vergaard werd. Bevrijdingsdag verwordt langzaamaan een Vrijheidsdag, maar zal nooit de slagen van de tweede wereldoorlog vergeten. Evenzo, blijven we grote kerken en paleizen gebruiken die niet zonder slavernij zijn gebouwd. We verbannen niet de kruiden en specerijen uit ons keukenkastje, desondanks de geschiedenis van onderdrukking onder de VOC.</div>

Dat een traditie ooit iets vertegenwoordigde waar je niet achter staat, hoeft geen reden te zijn er van af te zien. Dat bewijzen ieder jaar de vele atheïsten die uitbundig Kerst vieren zonder cynisch te refereren aan immorele delen in de bijbel. Voor hen is Kerst een mooi feest vol van gezelligheid, waar we warme herinneringen aan hebben. Ja, mensen zijn groepsdieren die van riten houden en zolang we dat onszelf niet willen ontnemen, is het perfect te vieren los van de historische context in de nieuwe betekenis die we er zelf aan geven.</div>

Een ander gebezigd argument tegen Zwarte Piet is de vrees dat kinderen leren dat 'zwart' een lagere rang betekent. Ik betwist of kinderen dit opsteken van het sinterklaasfeest. Ik ken niemand die na het vieren van het sinterklaasfeest etnocentrische trekken heeft ontwikkelt. Zelfs toen Zwarte Piet mij discrimineerde omdat ik te groot was voor pepernoten <span style="background-color: white; color: #444444; font-family: arial, sans-serif; font-size: x-small; line-height: 16px;">—</span> terwijl mijn klasgenootjes wel kregen, heb ik geen seconde getwijfeld aan Piet zijn status. Als kinderen daar überhaupt al mee bezig zijn op die leeftijd.<br />

Is het nu écht zo belangrijk dat Zwarte Piet zwart is? Ja. Om dezelfde reden dat de Kerstman een witte baard heeft, moet Zwarte Piet zwart zijn. Tradities zijn per definitie feesten der herkenning die je opvoert zoals je ze kent. Betekent dit dat we onszelf cultureel-orthodox op moeten stellen en star moeten volharden dat er niets mag veranderen aan het Sinterklaasverhaal? Absoluut niet. Dezelfde vrijheid die ons kan kwetsen, hebben we ook om het Sinterklaasverhaal naar de huidige tijd aan te passen. De opmerking van minister-president Rutte dat er niets aan te doen is, omdat Piet nu éénmaal zwart is, is niet beter dan het standpunt dat het huwelijk 'nu éénmaal' iets is tussen een man en een vrouw en daarom per definitie andere vormen uitsluit; een drogreden. Het beeld van een ongenaakbaar Sinterklaasfeest klopt geenszins Sinterklaas wordt in Europa overal anders gevierd. In Duitsland wordt Sinterklaas bijgestaan door de strenge Knecht Ruprecht, in de Alpen is het Krampus, een groot duivels personage, dat kinderen op de stuipen op het lijft jaagt. Ook in Nederland heeft de traditie nooit stilgestaan. De angst voor de zak en de roe hebben plaats gemaakt voor marketingacties zoals het zetten van ingekleurde papieren schoen bij de supermarkt. Nota bene, het gehele sinterklaasverhaal van een bisschop van Mira, die komt uit Spanje, klopt natuurlijk al van geen kant. Dus als we het willen, is er niets wat ons tegenhoud!</div>

Als we vaststellen dat Zwarte Piet een etnocentrische oorsprong kent, is die betekenis volledig verloren gegaan. Dit lijkt mij dan ook geen reden om Zwarte Piet aan te passen. Toch is het een feit dat er mensen zijn die zich er wel aan storen. Ongeacht of dit rationeel is, we kunnen ze een groot plezier doen met een aanpassing. Dus waarom niet samen tot een oplossing komen waarbij mensen die zich geraakt voelen, zich er ook in kunnen vinden? Zwarte, blanke of bonte Pieten, voor de beleving van de kinderen maakt het niet uit.<a href="http://www.ad.nl/ad/nl/1013/Buitenland/article/detail/3532453/2013/10/24/Op-Curacao-hebben-ze-al-regenboogpieten.dhtml" target="_blank">[17]</a> Het zijn de volwassenen die over elkaar heen stommelen. Dominee Gremdaat zegt het juist: "Hou nou toch eens op met die zeurende discussies". En denk eens in de geest van Sinterklaas die altijd zegt: "het is een feest voor iedereen, geen huis wordt overgeslagen". Verpieterman u, stap uit die juten zak en kom tot een Sintwaardige oplossing.</div>

<b>Een strijd om de stem van de kiezer is losgebarsten. Buiten wat politici tijdens deze ratrace zeggen, is het even zo interessant om te horen wat kiezers denken. De afgelopen weken heb ik mijn oor te luisteren gelegd, bij de enige vraag die ik stelde: "Waarbij let jij op als jij je stemkeuze maakt?" Vaak hoorde ik interessante meningen. Maar ook dubieuze argumenten. Dit zijn de drie slechtste argumenten die iemands stemgedrag bepaalde. </b><br />

1. <i>Ik kijk naar mijn eigen belang</i><br />
Veel mensen kijken vanuit dit perspectief naar partijprogramma's. Eigenlijk kijk je dan of je je kan verrijken met je stem. Je kiest dan voor méér subsidies voor hetgeen waarvan jij gebruik maakt. Rijd je auto, dan wil je graag dat de wegenbelasting naar beneden gaat. Hoewel iedereen graag rijk(er) wilt worden, is het belangrijk om ook te kijken hoe we tezamen rijker worden, in plaats van ten opzichte van elkaar. Denk na over de consequenties van een stem uit eigen belang. Bijvoorbeeld, hoe beïnvloedt een verlaging in de wegenbelasting het gedrag van andere mensen, en is dat wenselijk? De vraag welke kant jij op wilt met de maatschappij is vaak belangrijker dan het pure eigen belang.<br />

<i>2. Het maakt niet uit op welke partij je stemt. </i><i>Ze doen toch wat anders dan ze beloven. </i><i>Het wordt toch altijd een compromis.</i><br />
Politici zijn er goed in om de schijn te wekken dat ze iets beloven, om het daarna niet waar te maken. Dit verschilt natuurlijk per politicus. Realiseer je altijd dat de partij waarvoor jij kiest, niet alleen kan regeren. In de coalitie moet altijd water bij de wijn worden gedaan. Waar jij voor staat wordt nooit helemaal waargemaakt, omdat mensen die voor een andere partij hebben gestemd iets anders willen. Wel geeft de positie van de partij waarop jij stemt richting. Het maakt dus wel degelijk uit welke volksvertegenwoordiger jij kiest.<br />
<br />
<i>3. Wie er ook zit maakt mij niet uit, als ze maar het goede doen.</i><br />
Het 'goede' is subjectief. De financiële crisis bestrijden door Griekenland uit de problemen te halen, is goed als je pro-Europa bent. Wie uit Europa wilt, zal dit niet het goede vinden. Er bestaat dus niet één iets wat 'het goede' is. Alle politici doen wat zij denken dat het goede is. Ook de politicus die het verste van jouw mening afstaat. Wat zij doen, vinden zij zelf namelijk heel goed. Je zou bijna geloven dat je naar de stembus móet gaan. Maar niets is minder waar. Het Nederlands stemrecht verplicht je tot helemaal niets.<br />

Natuurlijk is er altijd wel een partij die dichter bij jouw standpunten ligt dan een andere. Maar wie echt geen flauw idee heeft welke partij hem of haar het beste vertegenwoordigt, kan bewust kiezen om niet te stemmen. Daarmee laat je de keuze over aan de rest van Nederland, wat een geheel rationele keuze kan zijn. Een vaak gehoorde kritiek is dat 'als je niet stemt, je ook je mond moet houden'. Dit geldt natuurlijk alleen als je geen belangstelling hebt in politiek en geen interesse hebt om je te verdiepen in de standpunten van de partijen.<br />

Tijdens de boekpresentatie in Amsterdam beschreef Mikkers de polarisatie tussen voor- en tegenstanders nu religie niet meer vanzelfsprekend is. Onvermijdelijk werd de commotie rond een recente uitspraak van SGP-fractieleider Kees Van der Staaij aangehaald, die in een reactie op de controversiële uitspraak van VS-Congreslid Todd Akin <span style="font-size: x-small;">[1]</span>, het een feit noemde dat zwangerschap bij verkrachting zich nauwelijks voordoet <span style="font-size: x-small;">[2]</span>. Aftredend CDA-Tweede Kamerlid Mirjam Sterk beaamde dat dit een vorm van religiestress is <span style="font-size: x-small;">[3]</span>.<br />

<b>Dom of volkomen rationeel?</b><br />
Het valt niet te ontkennen dat een deel van de reacties op de controversiële uitspraak doelt op de connectie met de religieuze achtergrond van de SGP. Maar het afdoen van alle commotie als 'allergie voor godsdienst', lijkt te simpel. Zou er geen commotie zijn, als dezelfde uitspraak gedaan was vanuit een niet-religieuze ideologie? Het standpunt van de SGP met betrekking tot abortus was niet onbekend. Dat de gereformeerde partij hierover een orthodoxe mening heeft, is niets nieuws. Wat de uitspraak van Van der Staaij abject maakt is de uiting van wetenschappelijke ongeletterdheid en klaarblijkelijke afkeer van de realiteit. <a href="http://www.rino.nl/docenten/Dhr-dr-H-W-van-Lunsen-Rik-2314.html">Rik van Lunsen</a>, Arts-seksuoloog aan het AMC, noemt de de uitspraken van Van der Staaij 'Domheid. Dit is een meneer die kennelijk leeft in een enclave in Nederland, verstoken van elke informatie van wat zich werkelijk in de maatschappij afspeelt' <span style="font-size: x-small;">[4]</span>. Daarmee wijst van Lunsen op het feit dat in de huidige informatietijdperk onwetendheid een keuze is geworden. 'Als je als wetenschapper kijkt naar alles wat je weet over voortplanting en vruchtbaarheid, en het voorkomen van ongewenste zwangerschap, is het evident dat de kans op zwangerschap bij een verkrachting niet wezenlijk verschilt of zelfs iets hoger is dan bij een gewenste zwangerschap.'<br />

Historicus Jan Dirk Snel noemt de houding van Van der Staaij echter 'een volkomen rationeel standpunt' en ontkent in het NRC Handelsblad dat Van der Staaij iets verkeerds zei: 'hij constateerde slechts dat de kans op zwangerschap na een verkrachting klein is (...) en hij legde de nadruk op dat dit soort zwangerschappen slechts een zeer klein deel is van het totaal.' <span style="font-size: x-small;">[5]</span> Gerieflijk gaat Snel er aan voorbij dat bagatelliseren een onbehoorlijke reactie is voor een partij die abortus in zijn geheel strafbaar wilt stellen. Dat een beweging dit standpunt deelt, is nog tot daar aan toe. Maar de SGP is een politieke partij die van dit standpunt wetgeving voor alle Nederlanders wilt maken. Verschrikkelijkst is het afdoen van zwangerschap na verkrachting als een statische afwijking. Een onmenselijke redenatie. Met hoeveel compassie Van der Staaij naroept dat het 'een vreselijk probleem is waarmee mensen in aanraking kunnen komen', het is zijn 'rationele standpunt' dat een vrouw dwingt een kind te baren van haar verkrachter.</div>

<b>De schouders ophalen</b></div>

Toegegeven, in een tijd dat we zoveel kennis hebben van de werkelijkheid om ons heen, is het moeilijk om vast te houden aan een zeventien eeuwen oud 'heilig schrift'. De worstelingen van de SGP tussen de bijbel en het heden, is in dat opzicht goed te begrijpen. Voor een buitenstaander ziet het er echter klungelig uit. Een <i>Powned</i>-bezoeker schreef: 'religie maakt deze mensen zo blind dat ze onomstotelijke wetenschap aan de kant schuiven.' <span style="font-size: x-small;">[6]</span> Dit valt niet direct te zeggen over Van der Staaij, maar het is wel opmerkelijk dat de SGP-voorman zich laat informeren door bladen die buiten de werkelijkheid staan. Dat is als de kop in het zand steken. Beter zou de SGP zich naast de bijbel ook verdiepen in de empirische werkelijkheid en dan kiezen waar ze voor staat. Vrouwen de vrijheid over hun buik afnemen, en dan bij een verkrachting schoudersophalend zeggen 'och, hoe vaak gebeurd dat nou?', is ronduit afschuwelijk.<br />

Wie hier geen probleem ziet, lijkt te tasten in het duister naar de oorzaak van alle commotie. Die ziet geen probleem in de wetenschappelijke ongeletterdheid, de afkeer van de realiteit en de ongekend ijzige bagatellisering. Voor hen is het onbegrijpelijk rumoer waarvoor de plakker 'religiestress' zich makkelijk leent. Daarbij hoort dat we onszelf voorliegen dat er geen ophef zou zijn, wanneer vanuit een niet-religieuze ideologie hetzelfde was gezegd. En zo is religiestress binnen een enkele dag al verworden tot een nieuwe kapstok voor al het onwelgevallige. Een pejoratief als 'islamofoob' of 'hater'. Lege hulzen als afleidend geschut. Wellicht verdient religiestress een nieuwe kans. Niet in de rol van stress <i>om</i> religie, maar <i>door</i> religie. Of zoals komediant George Carlin zich in de jaren '80 al verbaasde over de abortusstress door religieuzen: 'Waarom noemen we het, als het om ons gaat, een abortus, en als een om een kip gaat, een omelet? <span style="font-size: x-small;">[7]</span><br />

Being an atheist does neither dismiss a person from believing in the existence of a <a href="http://en.wikipedia.org/wiki/Russell's_teapot">celestial teapot</a>. But in practice all atheists do not believe in teapots fuddling like celestial bodies through the galaxy. We miss the <a href="http://en.wikipedia.org/wiki/Evidence_of_absence">means to disproof</a> this, and there is also no legitimacy in drawing such a hypothesis. Empirical evidence is lacking and does neither accrue to a plausible explanation for yet unexplained phenomena. In other words, it does not tell us anything.</div>

Virtually all convinced and outspoken atheists understand this logical presumption. Their attitude towards 'believing' is always based on the evidence they know. Such a person does not have faith in public transportation, he rather knows from experience that his belief is justified. Since people have different levels of knowledge their beliefs diverge from one other. My friend who goes by train every day may have a more positive belief about public transportation than a car driver who only hears the news that trains get stuck often.</div>

Believers often assert that atheists have beliefs themselves and infer from this that believing is not stupid. Too often atheists get swept of their feet by this argument. Recently the argument successfully silenced Kate Smurthwaite of the National Secular Society (UK) in a live debate on BBC1. [<a href="http://www.youtube.com/watch?v=mhwyVe--TaE&t=7m55s">video</a>] The comment came after her rebuke that she does not belief on the basis of faith "because I am not an idiot". One of the members in the debate replied her arguing "money is not real, but you believe in it". It was unfortunate and almost embarrassing to see that she had troubles using this example to her advantage. It looked like you she was not prepared for this response and started to doubt, right after she made her very strong remark. The answer she should have given is fairly simple. Atheists do have beliefs about many things. That is indisputable. But they are skeptical believers. They believe that bank notes have value. Not on the basis of faith, but on the basis of evidence! The belief in the value of money is proven with each transaction we make. An incredible amount of evidence, that is. Now, what was the last time the concept of God proved itself?</div>

</tbody></table>Deze afwijking van de regel past bij een reeks van incidenten. Zo mag een ambtenaar - net als iedere gehoorzame burger - niet discrimineren op basis van hun geaardheid. Toch liet Minister Bijleveld onlangs weten dat ambtenaren die uit gewetensbezwaar weigeren een homo-stel te trouwen, gedoogd moeten worden. Zelf noemt ze dat 'tolerantie' en 'ruimte voor diversiteit'. In werkelijkheid geldt hier de <span class="Apple-style-span" style="font-family: Georgia; font-size: 14px; line-height: 20px;"></span>wet van de onderbuik. Maar wel een selectieve. Een agent die weigert een bon uit te schrijven voor een invalide die dubbel parkeert, zal zich niet op gewetensbezwaar mogen beroepen. Nee, gewetensbezwaar is een recht waarop enkel gelovigen zich mogen beroepen. In België wordt daar anders mee omgesprongen. Toen Koning Boudewijn I, gewetensbezwaar had bij het ondertekenen van een abortuswet, werd die tijdelijk uit zijn functie ontheven.<br />

Polderend Nederland zit met dit onderwerp in zijn maag. In de Tweede Kamer tekent zich dan wel <a href="http://www.refdag.nl/nieuws/politiek/kamer_blijft_tegen_onverdoofd_slachten_1_570585">een meerderheid</a> af voor een algeheel verbod op onverdoofd slachten, in de achterban heerst verdeling. Onlangs liet de achterban van D66 <a href="http://www.nu.nl/politiek/2526641/geen-verbod-onverdoofd-slachten.html">in een motie</a> weten, teleurgesteld te zijn dat hun fractie het wetsvoorstel van Marianne Thieme steunt. Deze opstand is 'uiterst frappant' te noemen voor een liberale partij, daar ze hiermee aangeven méér rechten te willen geven aan mensen met een irrationeel bijgeloof. Ook de achterban van de PvdA lijkt niet ongevoelig voor de (vooral Joodse) lobby. </div><span class="Apple-style-span" style="font-family: Georgia; font-size: 14px; line-height: 20px;"><br />

<div style="text-align: justify;">De religieuze lobby blijkt erg effectief. Vanuit islamitische hoek - die het debat liever breder trekt dan enkel het verdoven - wordt graag verwezen naar de praktijken in de bio-industrie. Daar zou eerst iets aan gedaan moet worden, eer er met een vinger gewezen wordt naar het onverdoofd slachten. De ironie is dat in Nederland vrijwel 100% van het Halal-geslachte vlees uit precies dezelfde bio-industrie komt. Het enige verschil is dat de dieren uit de bio-industrie - dus nadat ze al een ellendig leven achter de rug hebben - voor de Joodse en Islamitische consument nog een keer ruim getuige moeten zijn van hun eigen martelgang naar de dood. Alleen al vanuit die realiteit is het verwonderlijk dat mensen een dier dit lijden verwensen.</div><div style="text-align: justify;"><br />
</div><div style="text-align: justify;"><b>Wat is Halal?</b></div><div style="text-align: justify;">De Joodse gemeenschap heeft een gemeenschappelijk standpunt. Onder moslims heerst juist verdeeldheid. Een groot deel ziet in dat de voorschriften van Muhammed de meest schone, humane waren in diens tijd met diens kennis. Zij zijn van mening dat juist de bedoeling van de profeet en niet de slachtwijze zelf letterlijk genomen moet worden. Deze groep is ook voorstander van verdoofd slachten, met of zonder een halal-certificaat. Een andere (brede) groep volgt graag de autoriteit van een certificeringsinstituut. Als die zeggen dat het vlees Halal is, dan consumeren zij het. Een volgende groep moslims vind verdoving niet halal als er geen sluitende garantie is dat alle verdoofde beesten weer bijgebracht kunnen worden. Immers, de Koran schrijft voor dat het slachten van een dood dier haram is - iets wat veel moslims graag vermijden. Daarnaast concluderen <a href="http://dierenrecht.org/fileadmin/documenten/vlees_eten_in_de_islamitische_traditie_eindrapport.pdf">onderzoekers van Dier en Recht</a> dat niet enkel de slachtwijze, maar ook het welzijn van het dier gedurende zijn leven maakt of het vlees Halal is. De wetenschap dat (vrijwel) al het halal-gecertificeerde vlees in de bio-industrie opgegroeid is, maakt de verwarring compleet. Een kennis van mij is dan ook om die reden vegetarisch geworden.</div><br />

<div style="text-align: justify;"><b>Verdoofd of lamgeslagen</b></div><div style="text-align: justify;">Voor de niet-gelovige is het vraagstuk veel eenvoudiger. Het gaat immers enkel en alleen om de wijze van doden. De vraag staat dus totaal los van de manier waarop het dier is opgegroeid. Sec gesteld, "willen we het dier eerst verdoven, voordat we het opensnijden?" Relevant daarbij is de manier van verdoven. Bij runderen gebeurt dat met <a href="http://en.wikipedia.org/wiki/Captive_bolt_pistol">een stootwapen</a> dat een klap uitdeelt op de hersenpan van het dier. Er zijn twee typen wapens. Het ene wapen deelt een genade klap uit op de schedel waardoor het beest direct buiten bewustzijn is. Een tweede penetreert de schedel. Hoewel ik niet weet welk wapen het meest wordt toegepast, weet ik wel dat het beest binnen een fractie van een seconde buiten westen is. Bij onverdoofde rituele slachting kunnen grote dieren zoals runderen tot zeker vijf minuten bij bewustzijn blijven, terwijl het bloed uit hun lichamen sijpelt. Het verschil in stress en leed is duidelijk zichtbaar gemaakt op videobeelden. Wie dit verschil met eigen ogen wil zien, kan <a href="http://www.youtube.com/watch?v=HQOKQ__3vQw">op deze link klikken</a> (schokkende beelden) en zien hoe kort een rund leidt tijdens een verdoofde slachting, en hoe lang de spartelingen doorgaan van een ritueel geslacht beest. </div><br />

Een andere vraag is of vrijheid van geloof ingeperkt moet worden. Deze vrijheid is voorbehouden aan aan aanhangers van georganiseerd geloof. En daarmee krijgen ze uitsluiting van strafvervolging, voor zaken die strafbaar zijn voor niet-gelovigen. De inperking van deze verruimde vrijheden, staat gelijk aan de vraag waarom gelovigen uitgesloten moeten zijn van vervolging als ze hetzelfde feit begaan. Nota bene, het eerste artikel uit onze grondwet verbiedt discriminatie wegens godsdienst. En daar lijkt sprake van als gesteld wordt dat het niet-religieuze slachterijen verboden is om onverdoofd te slachten. Ook buiten de juridische context, is het schrijnend wanneer een groepering meer rechten krijgt dan de andere. Nu gebeurt dit met mensen die een irrationeel bijgeloof aanhangen. En het is de vraag of dit niet eerder een politiek dan een gezond argument is. Buiten het geloofsargument is er geen andere reden waarom iemand deze beesten een lang lijdensweg toewenst. Het is dan ook treurig dat dit over de rug van veel dierenleed uitgespeeld moet worden. Iets meer empathie voor het beest, dan voor de heiligheid van het bord, zou het debat sieren. Als dit volgens Wagemans "lef hebben" betekent, dan hoeven we enkel nog maar de meerderheid te volgen om tot waarheidsvinding te komen. </span><span class="Apple-style-span" style="font-family: Arial, Helvetica, sans-serif;">Wagemans, als specialist op het gebied van dialectiek zou moeten weten dat dat niet is waar grote filosofen als Hegel en Marx voorstonden. Ik wil graag reageren op uw column van dinsdag 14 juni 2011 op Nu.nl, 'Het agnosticisme is zo laf nog niet'. In dit artikel stelt u dat Van Hooff een denkfout maakt door te zeggen dat er meer controverse bestaat bij deze kwestie dan bij andere kwesties. Hoe goed dat argument ook klinkt, met uw kundigheid in dialectiek zal u ook moeten weten dat het aantal mensen dat iets vindt, nog niets vertelt over de juistheid van het statement. These en antithese moeten evenwichtig zijn. De tegenstelling theïst-atheïst zal dus ook niet vervuild moeten worden met het niveau van de controverse. De synthese zal moeten volgen uit een evenwichtige voorstelling van de feiten en argumenten zoals dat ook zou gelden voor een kwestie tussen Zonnisten en A-Zonnisten, of Londenisten en A-Londenisten.</span><br />
<span class="Apple-style-span" style="background-color: white; color: #073763; font-family: inherit;"> <br />
Anders gezegd, het controverse-argument is binnen een these een zwak argument, en buiten de these een ondermijning voor gedegen synthesevorming. Zo zullen grote filosofen als Kant dat nooit bedoeld hebben. Anders zouden we veel langer gedacht hebben dat de aarde plat is.<br />

Dit gezegdhebbende ervaar ik een onbekendheid met de terminologie voor agnostici en atheïsten. Ik wil u drie punten meegeven.<br />

<li><span class="Apple-style-span" style="background-color: white; color: #073763; font-family: inherit;">Ten eerste is 'agnosticisme en atheïsme' een kwestie van én-én, terwijl er vaak wordt gediscussieerd als óf-óf. De meeste atheïsten zijn zowel agnost als atheïst. Het ene is een uiting van kennis, de ander een uiting van geloof. Als je het als een tijdschaal ziet van theïst naar atheïst, dan is agnosticisme vaak een middelpunt, of middenweg. Maar feitelijk zijn het uitspraken op totaal verschillende hypotheses. Overigens, als je daarnaast theïsme als slecht voor de samenleving ziet, kan je ook nog anti-theïst zijn. Weer een én, niet óf.<br />
</span></li>
<li><span class="Apple-style-span" style="background-color: white; color: #073763; font-family: inherit;">Ten tweede is het belangrijk te weten dat een atheïst niet zegt dat er géén God is. Het is het ontbreken van het geloof dat er wél een God is. Als we de juist analogie volgen, is iemand die een gebrek aan geloof heeft in de stelling 'er zijn mensen op de zon', een A-Zonnist, niet een Aardist zoals u wenst te stellen.<br />

<li><span class="Apple-style-span" style="background-color: white; color: #073763; font-family: inherit;">Ten derde zijn Atheïsten atheistisch bij gratie van mensen die hen die vraag stellen. Anders gezegd, zou theïsme niet bestaan, dan bestaat er ook geen atheïsme. Zie hier waarom we weinig horen van A-Zonnisten of A-Londenisten. </span></li>

Om bij het voorbeeld te blijven: Mensen-op-de-zon-agnosten, zeggen dat we nog te weinig weten van de zon om met zekerheid vast te kunnen stellen dat er écht geen mensen op de zon zijn. Een mensen-op-de-zon-atheïst zegt dat hij de propositie 'Er zijn mensen op de zon' verwerpt. In de praktijk geeft vrijwel iedere atheïst op dat hij dit doet omdat er geen aanwijzing zijn dat de hypothese wél waar is. Van Hooff vraagt zich dus af waarom mensen die stellen dat we te weinig weten over het bestaan van een God (agnosten), het geloof in de hypothese niet kunnen verwerpen, net zoals ze doen bij andere hypotheses. Richard Dawkins verwoordde dit in zijn documentaire The God Delusion als: "Nobody but a lunatic would say 'well I prepare to believe in the [celestial] teapot, because I can't disproof it'. Maybe we have to be technically and strictly agnostic. But in practice we are all teapot atheists."<span class="Apple-style-span" style="font-size: small;"> </span> <span class="Apple-style-span" style="font-size: small;"> </span></span><br />

Maar dat is weer wat anders, namelijk een argumentum ad ignorantiam.</span></span></li>

This mental activity we call 'empathizing' distincts humans as social-beings who are capable to help, cooperate and display altruistic treats. While placing ourself in the skin of another person we learn what triggers their behavior, and how we can solve mutual disputes.<br />
<br />
Evolutionary, we have the tendency to divide the world in 'us' and 'them', which interferes with our ability to step in the shoes of someone we dislike. In fact, a lack of empathy allows humans to engage gleefully in cruelty and torture towards the ones we hate. This explains why it's difficult to empathize with a pedophile, or a murderer. Even the thought of it, confuses people and generates frustrated answers like "What to understand about him, he is a lunatic" or "the thought of standing in his shoes makes me nauseating".</div><div style="text-align: justify;"><br />
</div><div><div style="text-align: justify;">Unfortunately, too often we do not see a deconstruction of the us-them dichotomy. When Bush coined the term 'the axis of evil', he obviously did not portray the citizens in that region as humans who want the best for their kids. Instead, they were seen as culprits, potential terrorists. With a scoop, whoever populated this geographical area was impeached with an image of unreasonable barbarianism. Such a depiction dwindles room to review their behavior in an unbiased way.</div><br />

What do you want the most, and what do you see around you?" Like any other source of information that helps me understand what people drives, this video had impact on me. Sam's message resonates one of the great lessons on modern warfare that Robert McNamara draw in his documentary <a href="http://www.imdb.com/title/tt0317910/">The Fog of War</a>. It says: Rule #1: "Empathize with your enemy".</div><br />

It is this personal position that transforms me into a progressive personality. For example, last week a Dutch woman - who is arrested under suspicion of neonaticide (<a href="http://en.wikipedia.org/wiki/Neonaticide">wiki</a>), was charged with 12 years of jail. A popular singer, exclaimed on national television that she should be charged with more years in captivity. It outraged me, since she is not a threat to the society other than to her offspring. After doing some research and empathizing with the perpetrator, my opinion would be that she needs therapy to battle her indecisiveness and overcome feelings of guilt and shame, that led to her atrocities.</div><div style="text-align: justify;"><br />

My empathy with the perpetrator results in progressive conclusions that more often than not receive disapproval as they contradicts public opinion. The paradox goes that the one who managed to overcome the us-them dichotomy and empathized with the perpetrator, gets grouped with 'them'. I've seen bigots accusing me for lacking empathy for the victims. But here is their fallacy: One does not have to support the cause of the person they empathize with. Maybe there is a lesson here to draw, which goes that 'you do not have to sympathize in order to empathize'</div></div></div></div><div style="text-align: justify;"><br />

This month Bulgaria succeeded the technical reports needed to enter Schengen. But their entrance is postponed by France and Germany (a.o.). Are the old member states indeed playing tricks on Bulgaria. Or is this just a blaming game by the Bulgarian and Romanian heads?</span></b><br />

It is no coincidence that just months after the entrance of Romania, a deal was made to build pipe lines to transport oil from the black sea to the Central-European market. As a result, European countries will be - from 2010 onwards - less dependent on Russia's oil (ref 1). Another large potential benefit is the cheap labor force the new member states have to offer.</div><div style="text-align: justify;"><br />
</div><div style="text-align: justify;"><b>Objections</b></div><div style="text-align: justify;">Despite these benefits, the western member states also detect problems on the pathway towards unification with Romania and Bulgaria. The newcomers are much less wealthy - which means they will put pressure on EU funds. The Worldbank lists them as upper-middle-income economies, while almost all EU-countries are high income countries with an income greater than $12,195 (ref 2). For example, the average income in Romania is one-filth of that of an employee in The Netherlands. This financial gap generates great appeal for an influx of immigrants across member states who are happy to do the low-income jobs in the richer member states. But if there is on thing that these countries learned during last 30 years from the influx of immigrant workers, then it's that it comes with a price: social-cultural problems. Every member state that experienced a growing population of foreign workers, crime rates went up, while social differences with the domestic population caused unrest. Eventually, this resulted in an EU-wide rise of far-right politicians and anti-immigrant movements. In all, the foreign workers were not that sexy anymore. There is no indication that Balkan workers adapt easier to western culture. Recent findings even describe Romanian teenagers as racist, anti-Semitic and homophobic (ref 12). When these youngster move to western countries where this rampant intolerance is absolutely unacceptable, a deeper widening up of the social chasm between autochthonous and immigrant people becomes ineluctable.</div><div style="text-align: justify;"><br />
</div><div><div style="text-align: justify;"><b>New strategy in The Netherlands</b></div></div><div><div style="text-align: justify;">The discussion whether old member states can (and want) to support more immigrant workers intensified over the last decade. Also the Dutch liberal party (VVD) is worried about a great influx of Bulgarian and Romanian immigrants to The Netherlands. It was even written down in the coalition agreement between the ruling parties VVD and the Christian Democratic party that accession to Schengen will be tied to progression with anti-corruption policy (ref 4). This came shortly after signals that most of the 2,25 billion euros from the EU-funds - to support the Romanian government to help fragile groups - ends up in the pocket of corrupt politicians and latent NGO's (ref 5). Recently, Henk Kamp (Dutch Minister of Social Affairs and Employment) expressed to favor a strategy focusing on activation of the non-working labor force. </div></div><div><div style="text-align: justify;"><br />
</div></div><div style="text-align: justify;"><b>High Corruption</b></div><div style="text-align: justify;">Another issue that the European Union takes highly serious is the high level of corruption. This issue is the number one focus area of the European Commission while it has Bulgaria under scrutiny. Even though the expectations were high, after the EU accession, Bulgaria slowed down its implementation pace of reforms - much like the 10 countries that joined the Union in 2004. Several months after the accession The Economist concluded that prime minister Stanishev and President Parvanov "seem unaware that membership brings obligations" (ref 3).</div><div style="text-align: justify;"><br />
</div><div><div style="text-align: justify;"><b>France versus Romania</b></div></div><div><div style="text-align: justify;">Also in France, the rising popularity of Front National, steers anti-immigration policy. The relations between France and Romania were under pressure after Sarkozy said to expel The Roma population. In January 2011 Romania succeeded on all of the technical reports for entrance to Schengen. But France and Germany showed that they favored a postponed accession. Instead of lobbying intensively with the strong arguments they built up during the years after joining the EU, Romania's president persuaded the largest EU-states by threatening to block EU-decisions. Manners that are largely discredited Romania as a loyal partner. Knowing that Schengen accession needs an unanimity decision, one may say that Romania clumsily shot itself in the foot (ref 6, 11).</div></div><div><div style="text-align: justify;"><br />
</div></div><div><div style="text-align: justify;"><b>Postponement</b></div><div style="text-align: justify;">The entrance of Bulgaria and Romania seems to be connected. If the countries enter, presumably both enter at the same time. Bulgaria became Schengen-ready early in April 2011 (ref 7), but the positioning by Romania on the subject made it less likely that France and Germany would grant them access to Schengen. France, Germany, and The Netherlands still favor a postponement. In the summer of 2011 the European Commission brings out a report on the Bulgarian progress of in fighting corruption. This report seems to be pivotal in the discussion when Bulgaria (and Romania) will enter the Schengen area. The postponement is expected to last at least until October 2011 (ref 9)</div></div><div><div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;"><div style="text-align: justify;"><br />
</div></div><div style="margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px;"><div style="text-align: justify;"><b>Double Standards</b></div></div><div style="text-align: justify;">As soon as France and Germany voiced their concerns about the accession of the newcomers to Schengen, the foreign minster of Romania, accused both countries for making "false arguments and artificial links", and that they "apply double standards to newcomers". These arguments equal the ones I hear from my Bulgarian friends. And indeed, France and Germany exhibit a different set of rules for these countries than they did for other countries. On the other hand, not all countries are the same, and the political context within voting states may change dramatically too. It is for this reason, that the decision to grant access to the visa-free area requires unanimity. These rules of the game imply that implementing the technical necessities is no guarantee for an open door. It only brings the key closer to the hole. It seems that the newcomers are either not used to this politics game, or just phrase the dilemma as if there was an absolute promise that unanimity would be granted by default. The question is if the member states should have know earlier that they had their objects? The objections were explicitly voiced in November 2010 by France's 'EU affairs minister Pierre Lellouche who warned against an automatic enlargement and said that the technical evaluations were not enough. He exclaimed that France and The Netherlands delay this decision at least until summer 2011 when the European Commission is set to present its annual report on the fight against corruption and organised crime in the two countries (ref 10). In this light it is more remarkable that Romania and Bulgaria act to be perplexed by the French decision</div></div><div><div style="text-align: justify;"><br />

<b>Een jonge moslima mag geen hoofddoek dragen in een Christelijke school. Aan tafel ontrekt een verhitte discussie als ik uit mijn mond laat ontvallen dat de uitspraak door een kantonrechter mij verbaast. Het gelijkheidsbeginsel "ik geen pet, jij geen hoofddoek" lokt mij, maar mijn onderbuik voelt een uitsluiting van moslims door christenen. Het ongebreitelde enthousiasme maakt snel plaats voor ongeloof over mijn verontwaardiging. Meningen volgen, ondanks mijn roep om feiten.</b></div>

Het lezen van de <a href="http://zoeken.rechtspraak.nl/resultpage.aspx?snelzoeken=true&searchtype=ljn&ljn=BQ0063&u_ljn=BQ0063">uitspraak door de kantonrechter van Haarlem</a> schept een duidelijker beeld. Het reglement van de school verbiedt naast hoofddoekjes, een hele reeks van (niet-gezichtsverhullende) hoofddeksels. Volgens de rechtbank heeft de school dit recht: <i>"In beginsel staat het [de school] DBC vrij om een dergelijk verbod in haar reglement op te nemen, zo goed als het andere scholen vrij staat om te besluiten het anders te doen." </i>Het gebeurt dan wel niet vaak, het mag wel. Een bekend voorbeeld van een andere school waar kledingvoorschriften gelden is de <a href="http://www.britishschool.nl/">Britsh School</a> in Voorschoten, waar het dragen van een uniform verplicht is. Of het Islamitisch college Amsterdam waar het voor meisjes <a href="http://www.islamitischcollegeamsterdam.nl/afsprakenregels.html">verplicht is</a> om een hoofddoek te dragen. </div>

Doorslaggevend blijkt de grondslag van de school waar de ouders van de jonge moslima, Imane Mahssan, voor hebben gekozen. Zij kozen niet voor openbaar onderwijs, maar voor het Don Bosco College, een bijzondere school met een Christelijke grondslag die niet bestuurd wordt door een overheid, maar door een stichting of vereniging. Van ouders die hun kinderen naar een bijzondere school brengen, wordt doorgaans verwacht dat ze deze grondslag onderschrijven danwel respecteren. De rechter rekent het de jonge moslima dan ook aan dat <i>"dat zij met haar eis om haar geloofsovertuiging te mogen uiten onvermijdelijk inbreuk maakt op de gevoelens van anderen, die menen het recht te hebben van dergelijke uitingen verschoond te blijven."</i> In andere woorden, haar ouders kozen voor een school met lange tenen, waar Imane - onder het mom 'ik mag staan waar ik wil' - op trapt.</div>

Door te kiezen voor dit type onderwijs, wordt geacht dat de leerlinge de reglementen die hieruit voortvloeien, volgt. Het is niet omdat ze moslim is, dat ze geen hoofddoek mag dragen. Maar omdat haar islamitische uiting in strijd is met reglementen die voortkomen uit de grondslag van de school. Van daaruit oordeelt de rechter dat de kledingsvoorschriften niet discriminerend zijn. Ook vind die dat er geen sprake kan zijn van inperking van de vrijheid van meningsuiting daar Imane niet weerhouden wordt om te kiezen voor een school waar ze haar geloof wel kan uiten. </div>

<i>"De rechter toetst slechts" </i>Maar het lijkt erop dat die en passant een mandaat schept voor bijzondere scholen om uitingen die strijdig zijn met de grondslag van de school te verbieden. Net zoals het Don Bosco College haar monotheistische grondslag kan aanwenden om herinneringen aan andere goden te sanctioneren, mag een islamitische school in zijn kledingvoorschriften opnemen dat die christelijke, atheïstisch, of homoseksuele uitingen eveneens niet toestaat. Let wel. Het mág. Het moet niet. Hopelijk hebben de meeste confessionele scholen korte tenen, en zullen de meeste studenten de grondslag van hun school respecteren in plaats van irriteren.</div>

Ergens heeft deze spirituele strijd iets hilarisch. Maar eerder nog wekt het gebrek aan respect van de leerlinge, en de intolerantie van de school een triest gevoel op. Voyant is het feit dat deze intolerante school bedient wordt met een evengrote lepel subsidie.<br />
